1. Who these terms cover
These Terms & Conditions govern access to FPSHost at fpshost.net and its hosting control panel. “You” means the account holder; “FPSHost” means the FPSHost hosting service. Contact admin@fpshost.net with questions before using the service. You must be at least 18 and legally able to enter a contract, or have a parent or guardian who agrees to these terms and supervises your use.
2. Your account and security
Provide accurate registration details and keep your credentials private. You are responsible for activity you authorize through your account. Use a strong unique password and enable two-factor authentication. Notify us promptly of suspected unauthorized access. We may investigate suspicious activity and limit access where reasonably necessary to protect users or infrastructure.
3. Plans, availability and free hosting
Resources, supported games and capacity are those displayed in your plan and control panel. Free hosting is subject to available capacity and has no contractual uptime or response-time guarantee. Unless your plan expressly says otherwise, only one free server may be claimed per person/account; creating additional accounts to evade limits is prohibited. We may change or discontinue a free offering with reasonable notice where practical. Emergency security action may be immediate. We do not promise that every advertised future game will launch.
4. Acceptable use
Do not use FPSHost for unlawful content, malware, credential theft, phishing, denial-of-service activity, unauthorized scanning, cryptocurrency mining, spam, resource abuse, or attempts to access another user’s files or systems. Do not bypass limits or distribute software, game assets or personal data without the required rights and permissions. You are responsible for moderating your community and meeting any rules applicable to it.
5. Your content and backups
You retain your rights in your content. You grant us only the rights needed to store, run, transmit and maintain it as part of the service. Keep independent, current backups and test your restores. Manual game-file backups do not include MariaDB databases; export databases separately. Backup availability, retention and successful recovery are not guaranteed unless explicitly included in a written paid agreement. This does not exclude responsibilities that cannot lawfully be excluded.
6. Prices, wallet and refunds
All displayed prices and account balances are in US dollars (USD). Wallet entries represent service credit, not a bank deposit. An administrator-added credit is not proof of payment. Specific paid services, taxes, renewal terms and refund conditions must be shown and agreed before purchase; these terms do not authorize unannounced charges. Statutory cancellation, withdrawal and refund rights remain available where applicable. Contact us to review a disputed charge or balance.
7. Suspension and termination
We may restrict or suspend access for material breaches, non-payment where applicable, legal requirements, or credible risks to people or infrastructure. Where reasonable and lawful, we will explain the reason and offer an opportunity to resolve it. Data may become unavailable or be deleted after termination; ask about export options before closing your account. We may retain limited records where required by law, to resolve disputes or to prevent abuse.
8. Service limitations and liability
To the extent permitted by applicable law, the service is provided on an “as available” basis without additional promises of uninterrupted operation, suitability for a specific purpose or error-free software. We are not responsible for failures caused by your modifications, third-party game software, your network or events outside our reasonable control, except where applicable law imposes responsibility. To the extent legally permitted, we exclude indirect or consequential losses and lost profits. Our aggregate contractual liability is limited to the fees you paid for the affected service during the preceding 12 months, but only where that limitation is lawful and fair. Nothing excludes liability for fraud, intentional misconduct, gross negligence, death or personal injury where non-excludable, or any mandatory consumer, data-protection or other statutory right.
9. Third parties and game publishers
FPSHost is an independent hosting service. Game names and trademarks belong to their respective owners. We are not endorsed by or affiliated with those publishers unless explicitly stated. Third-party services and game software may have their own terms. You are responsible for obtaining any licences needed for your use.
10. Changes and disputes
Material changes will be notified through the site or an available account contact where appropriate; they apply prospectively, subject to mandatory law. Contact admin@fpshost.net first so we can try to resolve a dispute. Applicable law and competent courts are determined by the rules that legally apply to the relationship; no term removes a consumer’s mandatory local protections or right to complain to a competent authority.
